‘I shot Tony’: Juneau man charged with homicide at remote cabin

A man was arrested in Southeast Alaska Sunday after allegedly shooting another man while he was taking off his boots.

The incident was first reported at 7:38 p.m. to U.S. Coast Guard personnel, who relayed the message to Alaska State Troopers. The radio message they received indicated someone had been shot at a remote cabin in Excursion Inlet, west of Juneau.

When troopers arrived at the cabin, they found a group of men waiting for them at the beach, including 53-year-old Mark De Simone. The other men identified De Simone as the shooter.

One of the men secured the scene where the shooting occurred, according to court documents. There, troopers found 34-year-old Duilio “Tony” Rosales, dead with two bullet wounds in the back of his head.

“Rosales appeared to have been sitting on the picnic bench removing his boots when he was shot and rolled to the ground,” troopers said in court documents.

The men at the cabin gave troopers a .41 magnum revolver they said was likely used in the shooting. Troopers noted Rosales had an empty holster at his hip but did not elaborate on whether the gun belonged to Rosales.

Two brothers at the scene, one of whom heard the shots fired, stated De Simone said, “I shot Tony. I shot him. It’s my fault,” and other statements to the effect of having killed Rosales.

De Simone was arrested and initially charged with one count of first-degree murder, two counts of second-degree murder, manslaughter and criminally negligent homicide, all relating to Rosales’ death. He was arraigned Tuesday and is being held in Juneau’s Lemon Creek Correctional Center under a $500,000 bail with a third-party custodian agreement.

Rosales’ body was transported to the State Medical Examiner’s office in Anchorage for an autopsy, according to troopers.
