Ex-Subway spokesman Jared Fogle sentenced to more than 15 years

Former Subway spokesperson Jared Fogle was sentenced Thursday to more than 15 years in federal prison, after pleading guilty to child pornography and sex crime charges.

Fogle agreed in August to plead guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography. The charges followed a July raid on his suburban Indianapolis home. The resulting criminal case destroyed his career as the public face of the nation’s largest sandwich restaurant chain.

Prosecutors sought a 12 1/2-year sentence, while Fogle’s attorneys asked for five years. Judge Tanya Pratt cited the serious nature of Fogle’s offenses in a sentence that went beyond the prosecution’s recommendations and said Fogle will have a lifetime of supervision after his release.

Before the 38-year-old was sentenced Thursday, his defense called forensic psychiatrist Dr. John Bradford, who has researched pedophilia and said he evaluated Fogle. Bradford, who addressed the court by phone, said Fogle’s “hypersexuality” was heightened by the extreme weight loss he experienced in college. Fogle was hired by Subway 15 years ago after he credited the sandwiches and daily walks to a franchise of the chain for helping him lose more than 200 pounds in a year.

Bradford said Fogle suffered from “mild pedophilia,” CBS affiliate WTTV reports, which the prosecution argued is not an accepted diagnosis in the scientific community.

The prosecution noted that Fogle owned child pornography that featured children as young as six years old.

Kodiak man gets 5 years for meth trafficking

A 55-year-old Kodiak man will spend five years in a federal prison for trafficking methamphetamine.

The U.S. Attorney’s office says in a release that Teodoro Berdan was sentenced Friday in federal court in Anchorage.

Prosecutors say the U.S. Postal Service intercepted a package sent to him at a Kodiak residence where he rented a room. Authorities replaced most of the meth with a sham substance last February and delivered the package.

Shortly after, federal officers raided Berdan’s room and found him hiding the box of drugs. In July, he pleaded guilty to a single count of possession with intent to distribute over 100 grams of a mixture and substance containing meth.

Man sentenced to 7 years in prison for burglary spree, stabbing

An Anchorage man was sentenced to seven years in prison on Friday for invading three homes in April and terrorizing the residents, including one man who was stabbed.

Superior Court Judge Michael Spaan handed down the sentence to 24-year-old Shane Mike, who in June pleaded guilty to two consolidated charges of first-degree burglary and first-degree assault as part of a plea deal, according to a statement from Assistant District Attorney Christina Sherman.

Mike originally faced half a dozen charges stemming from a string of home invasions in the early morning hours of April 2. The first victim reported Mike entered his apartment and threatened him with a letter opener before making the victim light a cigarette for him. Mike fled the residence when the victim called police.

A short while later, a woman alerted police to a similar incident in a nearby apartment. Mike broke into her residence and began shouting at her and a 25-year-old man. Mike claimed they had stolen money from him and a fight between the man and Mike ensued, during which Mike stabbed the man. Mike fled and entered a third home, where he reportedly used the bathroom and left, according to police.

At least a dozen police officers responded to locate Mike, including K9 Aerie, who was deployed when Mike refused to comply with police. A Taser was also used to subdue Mike and arrest him.

When he was arrested, Mike was on felony probation for a prior burglary conviction, Sherman wrote. He has more than 20 convictions in the state of Alaska, including burglary and criminal trespassing.

XS Platinum manager agrees to felony charge in Clean Water Act violations

BETHEL — James Slade, the former XS Platinum manager convicted of violating Federal Clean Water Act regulations, has agreed to plead guilty to a felony count, according to First Assistant U.S. District Attorney Kevin Feldis.

The former manager was originally charged with two misdemeanor crimes regarding the violations. Slade, along with two other Australian executives are accused of increasing efforts to recover platinum from an old mine on the edge of the Kuskokwim Bay, from 2010-2011—despite its potential hazards.

The extraction allowed dirty water in a pond to ender the Salmon River, according to prosecutors in early October.

The water turbidity, or its cloudiness, increased more than 200 times the amount allowed under federal law. This turned the clear water to a dirty brown.

The two Australian executives returned to their home country to evade charges. But Slade, who is Canadian, has had his passport taken and has to stay in the country for sentencing.

Feldis says earlier this month, the jury was deadlocked on whether to go ahead on a felony charge for Slade, but ultimately agreed to plead guilty.

His change of plea hearing is set for Dec. 11, and the sentencing trial is expected to take place in mid-January.

Anchorage police: Man injured after gunshots fired at vehicle in midtown

Anchorage police are investigating a shooting that occurred early Sunday morning in midtown.

Just after 4 a.m., the Anchorage Police Department received a call that a male had shown up to a local hospital with a gunshot wound to the leg.

Further investigation revealed the victim was the front passenger in a vehicle traveling in the area of C Street and International Airport Road. Police say another vehicle pulled up on the passenger side of their vehicle and fired several rounds.

“The victim vehicle was hit multiple times,” a release from APD says. “The victim vehicle immediately drove to the hospital.”

Police say the victim’s wound is non-life-threatening, and the other two people in the vehicle were not injured.

At this time, APD is not releasing any suspect information, and no arrests have been made in this incident.

Western Alaska woman arrested for attempted murder in connection with shooting

A 23-year-old woman is accused of attempted murder for allegedly shooting a man in the Western Alaska community of Lower Kalskag last week.

Raven Levi, 23, was arrested for first-degree attempted murder after allegedly shooting the 39-year-old man in the abdomen, according to an online dispatch from Alaska State Troopers. The shooting victim — who troopers did not identify — was flown to Bethel and then Anchorage for medical treatment and listed in serious condition.

Friday around 11:40 p.m., troopers in Aniak received a report that the 39-year-old Lower Kalskag man had been shot. A medevac responded from Bethel, picking up a trooper and village public safety officer while en route, the dispatch says.

An investigation found Levi, also of Lower Kalskag, shot the 39-year-old victim with a .44-caliber revolver, troopers wrote. She is being held at the Yukon Kuskokwim Correctional Center.

Levi and the victim are believed to be in a relationship, said AST spokesperson Megan Peters in an email.

Not guilty plea entered in rural Alaska abduction case

A not guilty plea has been entered in the case of a man accused of repeatedly raping a woman and holding her captive for five weeks in Alaska.

The Fairbanks Daily News-Miner (http://is.gd/4IJCFS) reported that 37-year-old Daniel Selovich of Manley Springs was arraigned Tuesday in Fairbanks Superior Court, where his public defender entered the plea on his behalf.

The attorney also requested a jury trial for Selovich on charges of kidnapping, sexual assault and assault.

The woman told Alaska State Troopers that Selovich took her to his property south of Manley Springs on Oct. 1 and held her captive.

The woman contacted a friend through Facebook, and Selovich was arrested on Nov. 8. He and the woman were taken to Fairbanks, where the woman was hospitalized.

Former caretaker gets 20 years for shooting death

A former in-home caretaker will spend 20 years in prison for fatally shooting a blind woman’s husband.

The Fairbanks Daily News-Miner reports (http://bit.ly/1MGipKm) no time will be suspended for 53-year-old Anthony Wayne Charleston under a sentence issued Wednesday by Superior Court Judge Paul Lyle.

Charging documents say the woman called 911 in March 2013 when her husband, 59-year-old David Schei, was shot and killed. In an interview with Alaska State Troopers, Charleston said he dropped the woman off at home. He said when he returned shortly afterward at her request, Schei started punching him.

An investigator wrote in charging documents that Charleston said he fell backward and pulled a gun from his pocket, shooting Schei.

Charleston apologized in court, and said he wasn’t a violent or angry person.

Anchorage jury convicts sex offender of molesting child

An Anchorage jury has found a man guilty of sexually abusing a child.

The state Attorney General’s office says jurors reached a verdict Wednesday, convicting Arthur Hapoff of sexual abuse of a minor. The trial lasted seven days.

Prosecutors say the 6-year-old victim was sexually assaulted in 2014.

Hapoff was previously convicted of an attempted sexual assault in 2003 and felony failure to register as a sex offender in 2013.

He faces 20 to 35 years in prison when he’s sentenced on March 22.

Spring Creek inmate faces attempted murder, assault charges

A man already serving time at the Spring Creek Correctional Center for attempted murder has been charged with assaulting and attempting to murder a fellow inmate.

The alleged assault occurred on Aug. 4, when 47-year-old Mark Spencer attacked a 41-year-old inmate at the correctional center in Seward. The victim was “cut seriously,” according to an online trooper dispatch, and was transported to Seward Providence Medical Center.

Charges against Spencer were filed on Nov. 24, and include one count of first-degree attempted murder, first-, second- and third-degree assault and promoting contraband. A weapon was used in the attack, court records show.

Spencer was serving time for another attempted murder case stemming from an attack on another inmate in July of 2011. In that case, Spencer used an aluminum bat to beat 37-year-old Floyd Boshears, according to the Peninsula Clarion. Boshears was treated for life-threatening injuries.

Boshears was later moved to the Palmer Correctional Center and filed a personal injury civil suit against Spencer, Spring Creek Correctional Center and the Department of Corrections.

The victim in the most recent case has not been named, and DOC spokeswoman Sherrie Daigle said further information on the case was not available from the DOC due to the ongoing investigation. Alaska State Troopers led the investigation into the assault.

Anchorage police seek wanted man, Dajon Hale

The Anchorage Police Department is asking for the public’s help finding 26-year-old Dajon Hale, who currently has two felony warrants for his arrest.

Police say in June, Hale was pulled over for speeding in a construction zone in the area of E. 56th Avenue and Lake Otis Parkway.

The officer then discovered Hale was on probation and called Hale’s probation officer, after which the officer was advised to search Hale’s vehicle “as a condition of that probation,” according to an APD release.

“Once Hale was informed of the search, he fled the scene in the vehicle,” APD says. “The officer initially pursued Hale but called it off after Hale’s driving became too erratic.”

Hale is wanted for eluding and for probation violation.

Police say Hale is aware of the warrants and is actively avoiding being caught.

Anchorage police investigate string of vehicle vandalisms

ANCHORAGE – Anchorage police are investigating more than a dozen vehicle vandalisms that started in the east part of town Monday afternoon and spread to midtown.

In all, there was hundreds of dollars worth of damage to the vehicles, said Anchorage Police Department spokesperson Jennifer Castro in a statement. Residents reported that it appeared that their car windows had been shot at.

The vandalism investigation started just after 2 p.m. Monday when a citizen in the area of Rosemary Street and East 20th Avenue told police their vehicle’s windows “appeared to have been shot out,” Castro wrote.

Less than half an hour later, APD dispatch received more calls from East Anchorage residents near Thunderbird Place who said their vehicle windows “had been shot out by what appeared to be a BB gun,” the police spokesperson said. Around 4:30 p.m., police received another call from a Nichols Street resident who said their vehicle’s windows had also been shot out by a BB or pellet gun.

Roughly three hours later — around 7:30 p.m., a citizen called Anchorage police and said “someone had just driven by their residence on Folker Street and shot at their home and vehicle,” Castro said.

Half an hour later, police received another drive-by shooting report from a caller in the area of South Tahiti Loop. The vehicle was described as “possibly a pickup truck,” Castro said.

There were more reports of vehicle windows being shot at in the Becharof Street and Rakof Avenue area.

Kasaan suspect scratches, bites at VPSO during arrest

A Kasaan Village Public Safety Officer was allegedly scratched and almost bit by a suspect during an arrest Tuesday morning.

The unnamed VPSO served 49-year-old Hal Priser, of Kasaan, with a court-issued stalking order around 10:30 a.m., according to an online Alaska State Trooper dispatch. The order banned Priser from the Kasaan city office.

Less than an hour later, troopers say Priser entered the Kasaan city office building, and the VPSO attempted to arrest Priser for violating the stalking order. Priser physically resisted the VPSO and tried to leave, scratching the VPSO’s neck and attempting to bite his hand and wrist, according to troopers.

The VPSO subdued Priser with the help of two other Kasaan residents and taken into custody. Priser was transported to the Craig Police Department Jail and held without bail, troopers wrote.

The VPSO suffered multiple lacerations to his neck as a result of the altercation.

Kasaan is located on Prince of Wales Island, northwest of Ketchikan.

Juneau police seek suspect who assaulted clerk, robbed hotel

Juneau police say they are looking for a man who allegedly assaulted a clerk and stole cash from a till at the Travelodge Hotel Tuesday evening.

Around 8 p.m. Tuesday, the Juneau Police Department said it received a call about a robbery at the hotel, located near the airport in Mendenhall Valley.

“The initial caller stated a woman had run through the Mi Casa Restaurant yelling that there was a man with a gun at the hotel,” said JPD in a release.

An investigation by police found the suspect — described as about 6 feet tall, 250 pounds and wearing black clothing and a ski mask — walked into the hotel and approached the clerk ”with his arm extended and hand covered under his sleeve as if he had a handgun,” the release says.

“As the suspect walked by, he punched a man who attempted to intervene and then threatened a female by motioning as if he was putting a gun in her face. The suspect then went behind the hotel counter and physically assaulted the clerk,” according to Juneau police.

The suspect took an “undisclosed amount of cash” from a till and then left the hotel, police say.

Juneau police ask anyone with information to contact the department at 586-0600.

Man changes plea to guilty in murder of Anchorage woman

An Anchorage man accused of killing his former girlfriend pleaded guilty in Anchorage court Wednesday.

Michael Memeo, 46, was originally charged with first-degree murder, second-degree murder and tampering with evidence in connection with the death of 54-year-old Irma Williams. He changed his original plea to guilty of second-degree murder as part of a plea deal.

Williams was reported missing by her family in September of 2014, weeks before her body was found in a shallow grave in Lions Park in Mountain View. A police investigation unearthed footage of a vehicle entering and leaving the park around the time Irma’s body was left there, according to prosecutors. The vehicle was connected to Memeo.

When police investigated Memeo’s apartment, blood and other “trauma” was found, prosecutors said.

Memeo was indicted in December of 2014 after an autopsy ruled Williams’ death a homicide.

One of the terms of Memeo’s plea deal was to serve 60 years in prison with 20 suspended, followed by a 10-year probationary period. He could face up to 99 years in prison if the terms of the plea agreement are not approved by the presiding judge. Superior Court Judge Kevin Saxby scheduled Memeo’s sentencing hearing for April 14, 2016.


UPDATE: Juneau knife fight victims ID’d; suspect arrested

Update on Thursday, Dec. 3 at 1:45 p.m.

Kevin Scott Nauska, 19, was arrested late Thursday morning in connection with the early-morning stabbing.

He has been charged with first-degree murder, first-degree attempted murder, first-degree assault, two counts of third-degree assault and tampering with evidence. He was taken to the Lemon Creek Correctional Center and held without bail, according to an update from the Juneau Police Department.

The stabbing victims have also been identified, police said, as next of kin has been notified. Jordon J. Sharclane, 37, was declared dead at the home. Sharclane’s son, 19-year-old Michael Sharclane, was hospitalized with serious injuries.

ANCHORAGE – A murder investigation is underway after one man was found dead and another injured in a stabbing at a Douglas Island home early Thursday morning.

Shortly before 4 a.m. Thursday, the Juneau Police Department received a call about a stabbing on the 3400 block of Foster Avenue. A 37-year-old man was found dead at the home, and a 19-year-old man was taken to Bartlett Regional Hospital with injuries.

An investigation found that a “dispute over property” led to a fight involving a knife, according to a statement from Juneau police.

“The other party in the dispute [is in] police custody and JPD is not looking for any outstanding suspects,” the statement says.

Juneau police, however, say they are looking for additional witnesses and ask people with information to call them.

Anchorage police search for suspect in attempted carjacking at gunpoint

Anchorage police say they are looking for a man believed to have fled a burning vehicle and then tried to steal a driver’s car at gunpoint.

Shortly before 8 a.m. this morning, authorities responded to a vehicle fire at the corner of Northern Lights Boulevard and Wesleyan Drive.

Not long after arriving at the scene, police received a 911 call from a citizen who said he had picked up a male in his car about two blocks away — in the area of Northern Lights and Boniface Parkway, according to a statement from Anchorage Police Department spokesperson Renee Oistad. Anchorage police say they believe the male who was picked up came from the burning vehicle — which was a 1995 Jeep Cherokee.

The citizen said he and the male suspect drove to the McDonald’s parking lot near the intersection of DeBarr Road and Boniface, where the suspect pulled out a gun and tried to take the driver’s car.

The driver refused to give up his car, and the suspect then ran away toward the Nunaka Valley subdivision. The driver was not injured, police say.

“Police notified schools and formed a perimeter, bringing in K-9 to conduct a track, but were ultimately unsuccessful in locating the suspect,” Oistad wrote. Nearby Nunaka Valley Elementary School went into “stay-put mode” for part of the morning, the Anchorage School District said.

The suspect is described as about 5-foot-5 and in his late 20s with dark hair and a close-cropped haircut.

Man with spice, box cutter arrested after Anchorage courthouse dispute

A man with packets of the drug spice and armed with a box cutter was arrested at an Anchorage courthouse Wednesday after he got into a dispute with security screeners.

Pete Crooke, 42, tried to bring drug paraphernalia into Nesbett Courthouse and challenged security screeners to a fight, according to an online dispatch from Alaska State Troopers.

“A foot pursuit ensued as Crooke attempted to flee from Troopers while armed with a box cutter,” the dispatch says.

Eventually, troopers were able to disarm Crooke and take him into custody.

In addition to the packets of spice and drug paraphernalia, Crooke also had “packaging material normally associated with distribution” with him, troopers said.

Crooke was remanded to the Anchorage jail on charges of third-degree assault on a police officer and disorderly conduct. He is being held without bail, troopers said, and more charges are pending.

 

Judge grants Fedolfi bail in Anchorage

BETHEL — Former Bethel Police Officer Aaron Fedolfi is out on bail in Anchorage, as of Monday, Nov. 30, according to court documents.

The bail amount was reduced from $20,000 to $2,500.

Fedolfi is the former Bethel Police officer charged with two misdemeanor counts of attempted sexual assault and official misconduct while serving with the BPD. After the complaints arose in September, Fedolfi was placed on administrative leave and quit. After charges were brought forth, Fedolfi went on a five-day run from authorities before being caught in Anchorage.

The bail hearing took place the day before Thanksgiving in the Anchorage courthouse. Fedolfi was released on the conditions that he wears an ankle bracelet, for GPS monitoring and is placed under house arrest.

According to court documents, he’s not allowed Internet access and can only use a monitored cellphone.

Fedolfi’s defense attorney paid the cash bond for Fedolfi’s release. This was the second bail hearing for the defendant. His lawyer tried unsuccessfully to have him released the previous week.

According to the documents, Fedolfi will stay at a hotel in Anchorage and has no family members in the city.

He’s due back in Bethel court on Jan. 5.

 

FBI: Anchorage doctor facing sexual abuse of minors charges tried to hire hit man to kill victim

Bail for an Anchorage doctor facing sexual abuse of a minor charges was revoked when the Federal Bureau of Investigation discovered he tried to hire someone to kill at least one of his victims.

Clifford Merchant, 68, was charged with 33 counts of possession of child pornography and sexual abuse of a minor in October of last year in a case that spanned more than a decade. Four victims were listed in court records, two of whom no longer live in Alaska.

Merchant’s original bail was set at $500,000, but recently retired Superior Court Judge Michael Spaan reduced the amount to $75,000. Merchant paid the amount and was released to two third-party custodians with a condition prohibiting him from having any contact with his victims.

Shortly after his release, Merchant and one of his victims, R.R., met with an individual referred to as “The Bull” in court documents. He reportedly tried to hire “The Bull” to kill the two victims living outside Alaska, according to affidavits from an Alaska State Trooper working with the FBI. “The Bull” was later arrested for an unrelated case, and agreed to work with the FBI as an informant against Merchant.

“The Bull” reinitiated contact with Merchant, who paid for his plane ticket up to Alaska, court records show. R.R. met “The Bull” at the Anchorage Westmark Hotel, and spoke with Merchant on the phone while there, according to court records. R.R. helped to arrange a meeting with Merchant at his custodian’s home.

The FBI outlined a conversation between Merchant and “The Bull” that was recorded and out of sight of Merchant’s custodian:

“The informant asked ‘how many?’ meaning how many victims. Dr. Merchant responded by asking how much it could cost for one victim. The informant indicated the cost would be about $30,000. There is additional conversation about whether it would be done by the informant himself, or someone local. Dr. Merchant appears to hesitate based on the price, and tells the informant that he needs to get ‘all the pieces in place.’ He gives the informant $1,000, to get things started and to compensate him for his time.”

Court records show R.R. then drove “The Bull” to their home, and then to the airport. The conversation between the two was also recorded, and R.R. gave “The Bull” a “slip of paper that indicated the names of [the two victims]… along with the cities that they live in and their places of employment,” court records read. R.R. told him the sister of one of the victims may also be a problem as she provided testimony in the case.

The FBI reported that R.R. later told him Merchant “did not want it done anymore.”

“What is unclear is whether Dr. Merchant has attempted to contract anyone else, or has fully renounced his intent to have his victims killed,” Assistant District Attorney Brittany Dunlop wrote in a motion to forfeit Merchant’s bail.

Anchorage Superior Court Judge Michael Corey approved a new bail amount of $10 million cash performance with a third party custodian on Nov. 24. No new charges have yet been filed in relation to the case.
